NBA seeks parliamentary hearing on Regmi gov appointments
NBA has demanded that the appointments made in the constitutional bodies during the Khil Raj Regmi-led government need to undergo parliamentary hearing.Pranab Kharel
NBA on Friday reached the conclusion on the matter after holding discussion with its former office bearers and chiefs of Kathmandu Valley chapter of NBA. It maintained that the appointments were made under special circumstances for the purpose of conducting the Constituent Assembly elections.
As the purpose has been served, NBA officials said, the presidential order that had paved the way for Regmi-led interim government to make the appointments has been rendered ineffective and the constitutional provision has been reactivated.
"This is a question of principle and the constitution upholds the provision of parliamentary hearing," said NBA General Secretary Sunil Pokharel.
The umbrella organisation of lawyers has sought the hearing of the appointments in line with Article 155 of the Interim Constitution that seeks parliamentary approval in advance of the appointments in the constitutional bodies.
The presidential decree issued in March 2013 is, however, silent on whether to conduct the parliament hearing. The decree only talks about tabling the appointments before the House within one month after the beginning of the session. The government has already tabled the ordinance in the Hose for approval.
The decision of NBA to demand parliamentary hearing comes at a time when CPN-UML, the second largest party in the CA has been demanding the same.
Meanwhile, the lawyers' organisation also met with CA Chairman Subas Nembang on Friday and drew his attention on the matter.
"We told him that the matter is now in the ambit of the parliament," said Pokharel, adding that Nembang has said that he has taken the matter seriously and would take it up in the House.
The government headed by the former chief justice had made appointments without parliamentary hearings after the dissolution of the previous CA. Some of the key appointments made by the Regmi government include Lokman Singh Karki as the chief of Commission for Investigation of Abuse of Authority.
The other appointments include that of Neel Kantha Uprety as the Chief Election Commissioner and Dolakh Bahadur Gurung, Ayodhee Prasad Yadav, PV Ram Bhakta Thakur and Ila Sharma (all EC commissioners); Kayodevi Yami the chairperson of Public Service Commission and Bhanu Prasad Acharya as the auditor general. Separate writs remains sub-judice in the Supreme Court, challenging the appointments of Karki as CIAA chief and Uprety as chief commissioner at the EC along with commissioners.
