SC Justice appointment: JC forwards recommendation copy to PHSC
The Judicial Council (JC) on Sunday forwarded a copy of its April 23 decision to recommend eight judges for the post of permanent justices at the Supreme Court to PHSC.The move comes in response to a decision of PHSC on May 8 to seek the copy of JC's decision to recommend eight names as permanent apex court justices.
A note of dissent filed by senior apex court justice Ram Kumar Shah regarding the recommendation has also been affixed to the copy of the decision.
Shah had on April 23 registered his note of dissent against two nominees-Govinda Upadhya and Deepak Raj Joshi. Shah maintains that Joshi has been reprimanded by the Supreme Court for releasing prisoners from jail. As for Upadhya, Shah argues that he doesn't have "a clean image" as he was involved in harassing a female collegue while being posted as chief judge of appeal court in Dipayal. Shah had also expressed reservation over the failure of JC to fill all permanent as well as temporary positions.
Meanwhile, as many as 22 complaints have been lodged against the eight nominees. They range from indulging into financial irregularities to "failing to uphold moral character".
Majority of lawmakers in the committee are also critical of the recommendation. Lawmakers from CPN-UML and UCPN (Maoist) had even demanded that the nomination be reverted back to JC, arguing that it was important to delve into the decision making process rather than the nominees.
Lawmakers from Nepali Congress, however, stressed on the need to conduct wider consultation on the matter instead of formulating their opinions about the decision based merely on media reports.
The PHSC is scheduled to meet on Tuesday to discuss the matter.
