CA Court rules in favour of lawmaker Mandal
Suspended UCPN (Maoist) lawmaker Ashok Kumar Mandal has been renistated by Constituent Assembly Court, ruling against the petition to invalid the result of the CA re-election.Ekantipur Report
A three-member bench led by Justice Kalyan Shrestha on Wednesday announced that there were no grounds to declare the re-election result invalid as demanded by Nabal Kishore Sah, the Sadbhawana Party candidate under the first-past-the-post (FPTP) category in the November 21 re-election.
Sah had challenged Mandal's win in the re-election, arguing that the returning officer did not conduct re-election under the Proportional Representation category.
He had also accused the local election authority of colluding with UCPN (Maoist) candidate Mandal. Furthermore, Sah had claimed that the returning officer violated the provision of informing the Election Commission (EC) about untoward events taken during the voting process.
After the petition was registered, the CA Court in January had suspended Mandal as a CA member, maintaining that the “the election officer conducted polls only for one category against the EC's directive.” It had concurred with Sah’s argument and noted that the EC was not notified about the incidents that transpired during the re-election.
Mandal had won the election, securing 6,057 votes, with Sah finishing second with 5,624.
