Advocate trio Prabin Bandak and Manish Kumar Shrestha and Rajeshowi Maharjan moved the apex court arguing it is against interim constitution and other laws to 'buy and sell' wombs of mothers.
The writ has been filed in the wake of rampant surrogacy services being run in various hospitals inside the country. Health Ministry is the defendant in the writ.
The litigants have demanded that the points on surrogacy on Nepal Health Policy be scrapped. The action plan of 12.4 in the health policy states that the infertility issue will be addressed through surrogacy services.
Talking to post, Bandak said they have also asked Supreme Court to invalidate the correspondence made by Ministry of Health and Population on surrogacy. She said they have also sought interim order on amendment to Human Body Organ Transplantation Act and include issues of surrogacy too.
