Even as the apex court rejected writ last Friday, advocate Roshan Kumar Jha had filed the writ seeking that army mobilised in riot-hit area be recalled from the ground. A single bench of Justice Sushila Karki has quashed the writing arguing that writ was not “true”.
Earlier, Chief Justice Kalyan Shrestha had quahsed the writ filed by advocate Jha. The writ petitioner had argued that the army could be mobilised only by the President on the recommendation of the Cabinet as per the Interim Constitution, but the government did not follow the constitutional provision to mobilise army personnel in the riot-hit districts.
