SC stays decisions to dismiss 2 chiefs

The Supreme Court on Thursday issued an interim stay order on the government’s decision to dismiss Nepal Telecommunication Authority (NTA) Chairman Digambar Jha up to July 19 besides issuing a show-cause notice.

The single bench of Justice Purushotam Bhandari also issued an interim stay order on the government’s decision to remove Chief Executive Officer of Deposit and Credit Guarantee Fund Bishnu Babu Mishra from his post up to July 18.

Justice Bhandari has called Jha and Mishra to discuss the issue on the July 19 and 18 respectively. Based on the discussions, the SC would decide whether to continue with the interim order or not.

On July 4, the Cabinet had decided to annul all political appointments made by the previous government led by Nepali Congress President Sher Bahadur Deuba.

The Cabinet claimed the appointments violated the Election Commission’s code of conduct.

The Cabinet had decided to revoke all political appointments made by the erstwhile government from August 30, 2017 to January 2, 2018.

The writ petitioners have urged the SC to reinstate them as they the government dismissed them without giving the opportunity of hearing. Four other officials have also filed a writ petition against the government’s decision on Thursday.

They include Cottage and Small Industries Development Board Executive Director Nabin Kumar Jha and Bagmati Civilization Integrated Development Committee Chairman Narendra Raj Basnet. Minimum Wage Fixing Committee Chairman Gangadhar Parajuli and, Gorkhapatra Sansthan General Manager Basanta Prakash Upadhyay.
