The division bench of judges Kul Ratna Bhurtel and Bir Bahadur Dangi on Tuesday upheld the district court’s ruling that recommended departmental action against Sub-Inspector Buddhi Prasad Sharma, Head Constable Dhan Bahadur Chand and Constable Man Bahadur Thapa for torturing one Jhup Bahadur Bista of Kachanapur in police custody. The court also ordered them to pay the victim Rs100,000 in compensation.
Thapa, who was arrested following a dispute between two groups in Agaiya of Banke three years ago, sustained serious injuries in his eyes, chest and other body parts due to the physical torture meted out to him while he was in police custody. After the incident, Thapa filed a case in the district court demanding punishment against the guilty and suitable compensation.
