SC upholds EC move of revoking Shiva Pujan Yadav’s candidacy

Yadav, a leader of the CPN (Maoist Centre) had filed his nomination for the federal parliament elections from Sarlahi-4.
The EC on November 25 had decided to scrap Yadav’s candidacy citing that the Special Court on August 11, 2015 had found him guilty of corruption in diplomatic passport misuse.
According to the Election to the House of Representatives Act, a person convicted of corruption and passport misuse cannot be a candidate.
Yadav had then moved the court on November 28 challenging the EC decision to revoke his candidacy.
A division bench of Justices Deepak Raj Joshi and Dambar Bahadur Shahi on Wednesday refused to issue an interim order on Yadav’s writ, which means his candidacy remains revoked. With the cancellation of Yadav’s candidacy, the left alliance doesn’t have its candidate in Sarlahi-4.
“The SC has denied issuing an interim order on Yadav’s writ. This means he is not a candidate now as said by the Election Commission,” said Narayan Prasad Panthi, spokesperson for Supreme Court.
The SC on Tuesday had issued a show-cause notice to the EC and the government over the decision to revoke Yadav’s candidacy.
The EC earlier had invalidated the candidacy of Nepali Congress leader Govinda Raj Joshi from Tanhun-1 for he was convicted of corruption the Special Court. His case is also sub-judice in the apex court.
