Heritage activists file contempt cases

Jul 20, 2018-A group comprising 104 residents, heritage conservationists, and local clubs has filed contempt of court application in the Supreme Court against Maharjan Business Associates Pvt Ltd (MBA) for constructing a private building on Hanuman Dhoka premises at Durbar Square.
The petitioners on Wednesday also filed contempt of court against 12 other government bodies for their failure to stop MBA even though the SC issued a stay order on the building until the next hearing.
Residents and heritage conservationists have held a series of protests against MBA for constructing the building breaching World Heritage Site rules.
They had earlier filed a writ on April 23 at the SC that issued a stay order until the next hearing of the case by August 1.
Construction work progresses undeterred, residents say. “We wrote letters to 12 different bodies, protested many times, but it was in vain as they did not listen. It is government’s duty to follow the court verdict that is why we have filed the contempt of court against these government bodies as well,” said Ganapati Lal Shrestha, a resident campaigning to save heritage sites.
MBA crew had dug a basement spreading over 627.98 square metres. This violates the Ancient Monument Preservation Act 2013 that does not permit construction of underground structure near heritage sites.
While granting permission, the Kathmandu Metropolitan City (KMC) had said the height of the building should not exceed 35 feet. However, the building is set to stand 42 feet tall.
The KMC had strictly told the company that each floor should not exceed 7.7 feet, but a report of engineers of the Kathmandu Valley Development Authority (KVDA) and the KMC shows all the floors are more than 10.7 feet.
