Bishwokarma was detained from Dakshinkali of Kathmandu on August 7 on the charge of extortion.
On Sunday, former minister Bishwokarma’s son Narendra Bahadur Singh Bishwakarma had filed a habeas corpus writ at the apex court claiming that his father was illegally detained along with Harish Chandra Acharya of Kalika Rural Municipality of Kalikot district and Man Bahadur Shrestha of Banganga of Kapilvastu district.
According to a SC official, a single bench of acting Chief Justice Om Prakash Mishra has ruled the government to present Bishwokarma along with written clarifications for his detention.
Writ petitioner has claimed leader Bishwokarma’s arrest was politically motivated and has demanded their immediate release.
He has also claimed that the authorities did not allowed Bishwokarma to take his medicines, displayed unpleasant behaviour by handcuffing him and are physically and mentally torturing him by blindfolding.
The Kathmandu District Court has allowed police to investigate the charges keeping him in detention for three more days. Earlier he was allowed five days in detention as per the Extortion Act 2030 BS.
