SC orders Home Ministry to release Bishwokarma

The Supreme Court on Monday ordered the Home Ministry to release Khadga Bahadur Bishwokarma, spokesperson for the Netra Bikram Chand-led Communist Party of Nepal (CPN).
A joint bench of Justices Sapana Malla Pradhana and Tanka Bahadur Moktan, hearing on a habeas corpus writ, on
Monday ordered the authorities to free Bishwokarma arguing that police had detained him going against the provisions of the Criminal Code.
Expressing serious concerns over repeated arrests of Bishwokarma notwithstanding the orders of the apex court and the Kavre and Nuwakot district courts, the SC drew the government’s attention to the matter.
Bishwokarma was first held from Dakshinkali, Kathmandu, on August 7 on the charge of disturbing peace in society while indulging in extortion.
On August 14, the apex court ordered the authorities to present Bishwokarma before the court within 48 hours after his son filed a habeas corpus writ.
Hearing on the writ, the SC on August 17 ordered the government to release Bishwokarma. But soon after the release, police re-arrested Bishwokarma from the Supreme Court premises on the charge of his involvement in the Ncell tower arson case.
In the second instance, Bishwokarma was re-arrested from the Supreme Court premises on August 23, shortly after the court’s order.
