Devi Kumar Joshi, a permanent resident of Dhangadhi Sub-metropolitan-5, filed the writ at the SC arguing that the forests of Godawari, in Kailali district, should not be destroyed in the name of capital. Joshi has made Cabinet, Far-West Chief Minister, Province Assembly Speaker, and coordinator of the special committee to recommend capital, Tara Tamang, as defendant in the writ.
The writ has sought a mandamus or any other appropriate order from the court directing to name the location apart from forest area while declaring the province capital according to Article 133 (2. 3) of the constitution of Nepal.
A meeting of the Province 7 Assembly on September 28 had approved the proposal to name the province as Far-West and declare Godawari as its capital with a two-thirds majority. The opposition parties Nepali Congress and Rastriya Janata Party had boycotted the assembly meeting, raising objection to the proposal.
