SC full court asks CA to revoke constitutional court provision
A full court meeting of Supreme Court on Monday asked the Constituent Assembly lawmakers to revoke the provision for forming a constitutional court.Ekantipur Report
The meeting presided over by Chief Justice Ram Kumar Prasad Sah held deliberations on the provisions of the preliminary draft of the new constitution and urged the CA to uphold the international practice on independent judiciary by removing the provision for constitutional court.
The full court meeting maintained that constitutional court would create unnecessary hassle in the judiciary system and is likely to arouse conflict among the courts.
The meeting held discussions on a report submitted by a three-member committee assigned to study the provisions related to judicial matters in the draft statute. Following the discussion, the meeting decided to write a letter to CA asking it not to go against the concept of independent judiciary as proposed by the justice conference, international practice on the judicial system and prevailing jurisprudence.
