Penner was deported four months ago on the charge of “inciting disharmony through social media”.
Besides, the Immigration Department claimed that he obtained working visa for a Sprout Technology company but worked for Cloud Factory, a foreign outsourcing company.
The hearing will verify the petitioner’s claim of forgery of a document that showed he had agreed to leave the country.
Responding to a writ petition, the apex court on May 23 had refused to issue a stay order against the decision to deport Penner, who was forced to leave the country as the Nepal government on May 3 ordered him to depart within two days.
