IG appointment case: SC orders govt to furnish clarification within three days

The division bench of Justices Hari Krishna Karki and Tej Bahadur KC directed the government to furnish written clarification.
Earlier on February 13, the SC had ordered the government to furnish clarification about its decision to appoint Deputy Inspector General Jaya Bahadur Chand as the new Inspector General of Nepal Police, suspending his appointment.
Today’s order was the continuation of its earlier decision.
According to SC spokesperson Mahendra Upadhyaya, the final verdict on the case would be issued after the government tabled the clarification.
The government’s decision to appoint Chand as the IG of Nepal Police was stayed by a single bench of Chief Justice Sushila Karki, hours after he was appointed as the new chief of Nepal Police.
The government on February 12 had decided to appoint Chand as the new chief of Nepal Police.
Advocate Kapil Dev Dhakal on February 10 had filed a writ petition, accusing the government of trying to violate the rule of seniority in the appointment of Nepal Police chief.
Later on February 12, DIG Nawaraj Silwal, the first in line for appointment, moved the SC seeking an order to stay Chand’s appointment.
Prime Minister Pushpa Kamal Dahal and Deputy Prime Minister and Home Minister Bimalendra Nidhi were said to be in favour of elevating DIG Silwal, but they failed to follow seniority and meritocracy in the process as provisioned in the Nepal Police Act.
Similarly, Nepal Congress, the largest and ruling party, President Sher Bahadur Deuba is learnt to have pressed Dahal to appoint Chand as the new NP Chief.
