Advocates Ananta Raj Luitel, Kedar Luitel, Manoj Khadka, Prabindra Raj Joshi and Rudra Pathak jointly filed the writ petition on Monday with Prime Minister KP Sharma Oli, UPCN (Maoist) Chairman Pushpa Kamal Dahal and the two ruling parties as defendants. The petitioners demanded a mandamus order to stop the agreement from being enforced.
The ruling parties on Thursday signed an agreement to move the peace process forward with necessary amendments to laws, including amnesty in conflict-era cases.
The apex court last year ruled that there would be no amnesty for perpetrators of serious human rights violations. The court has already struck down the provision of clemency as well.
The petitioners argue that the pact would infringe on individual’s fundamental rights to seek constitutional remedy.
